An Emperor Prime Minister is a Threat to Malaysia’s Parliamentary Democracy

There seems to be no end to the incredulity by the country’s top executive in clearing both the Prime Minister as well as the government backed investment mammoth , 1MDB – perception wise.

The latest twist saw an unsigned MACC statement clear the RM2.6 billion found in our Premier’s personal account – as mere donation money – after many weeks of allowed speculation and feigned ignorance to the existence and nature of the personal accounts.

Notwithstanding the Malay translation is “derma” falls within the ambit of the MACC as “suapan” : “suapan” ertinya –
(a) wang, derma, alang, pinjaman, …….. atau apa-apa manfaat seumpama itu yang lain;

This definition then opens the door wide open for the person responsible – in receiving or paying a bribe – to be in violation of Section 3 and Section 50 of the MACC Act respectively. Specifically Section 16 of the Act highlights that those found guilty can be jailed up to 20 years. Clearly if the Executive is seen to hamper an Anti Corruption Agency; it is a move most detrimental to our parliamentary democracy.

While the MACC resolve its wide ranging dilemma from releasing unsigned statements to last minute prayers for a corrupt free regime plus integrity to prevail; we are left wondering on the roles of the following institutions :

Bank Negara – our Central Bank. For the first time in Malaysian history, our Governor is being sought after the IGP for investigations related to section 124B being detrimental to parliamentary democracy – in the exact moment the public awaits the outcome of a task force she jointly chairs – investigating none other than 1MBD and the PM (Chair of 1mdb advisory board). Any threat and harassment against the Governor – the bastion of Malaysia’s economic and financial wellbeing – is certainly a threat against our parliamentary democracy.

As arrests and investigations become the prevailing order – we are left asking : Does BNM have anything to comment on the massive inflow of fund? How did the transfer of RM2.6 billion escape the AMLA automated alert?

Who was the deep pocketed donor allegedly from the middle-east that donated this money to the PM? An immediate disclosure of the nameless middle-east donors must be made as Israel also is in the middle-east.

Was the donor from SRC international and how was the money utilised? Was the money used to fund the Barisan Nasional 2013 General Elections campaign?

Affronts within the executive have also taken place with the PM sacking of his Deputy and members of his cabinet who were vocally critical against him and the 1MDB fiasco.

Whilst the sacking can be replaceable with other like minded yet less outspoken UMNO / BN leaders;  the same cannot be said for the removal of the Attorney general -in the background of a rumored purported charge sheet against our Premier.

In his place we have a new AG, no less a former UMNO member and disinterested in either disclosing the interim AG’s report on 1MDB or updates on the now derailed investigations by the 1mdb task force . The main cause for the Derailment is the often used phrase of being detrimental to parliamentary democracy.

Whither the PAC? Courage of members easily wilt in the face of cabinet upgrades – whilst the remaining members of the corum are blocked from continuing meetings , deliberations, or downright access to the PAC office.

The fourth estate is also not spared by our executive – latest victims include The Edge Financial Daily – whose dogged interest in exposing the 1MDB saga has cost it a 3 month ban. Whistleblower site Sarawak Report is not only blocked but there is also an arrest warrant on its owner.

Clearly, the fourth estate is being severely attacked – a move that is most detrimental to our parliamentary democracy .

Malaysians – on the other hand – will not enjoy rights enshrined under Article 10 of our Federal Constitution – as those assembled against the Prime Minister’s involvement in allegations of embezzlement and corruption are spuriously arrested – the list of 37 arrested include an octogenarian and a minor in last Saturday’s #DemiMalaysia rally.

​Such systematic dismantling of democratic principles of separation of power threatens our parliamentary democracy .

The more that Prime Minister strengthens his authoritarian and emperor like grip, the more frail our parliamentary democracy becomes.

Such growth of authoritarianism will only bring the country into further ruin and disrepute.

Malaysians cannot live with an Emperor.  All agencies and democratic institutions must be reminded to achieve this aim and end the reign of the emperor Prime Minister. The wellbeing of the Rakyat and survival of the nation are predicated on a working and thriving parliamentary democracy.

Dalam suasana rakyat tertekan akibat kenaikan harga barang dan Barisan Nasional terus memotong subsidi dan perbelanjaan pro-rakyat yang lain, saya terkejut dengan sikap tiada kepedulian pentadbiran Dato’ Seri Najib Tun Razak yang dengan sewenang-wenangnya membeli sebuah jet peribadi (“private jet”) baru.

Menurut jawapan Parlimen yang diberikan Jabatan Perdana Menteri pada sidang November 2013, Kerajaan Malaysia sudah mempunyai sekurang-kurangnya 6 jet peribadi termasuklah sebuah Boeing Business Jet.

Saya sertakan bersama satu surat perjanjian yang mengesahkan pembelian jet baru ini yang bertarikh 1 Disember 2014. Perolehan jet peribadi baru untuk Perdana Menteri ini dianugerahkan secara rundingan terus kepada Jet Premier One (Malaysia) Sdn Bhd yang turut mengendalikan jet peribadi sedia ada iaitu ACJ319.

Penggunaan jet peribadi sedia ada iaitu ACJ319 melibatkan kos sebanyak RM28.8 juta setahun dalam bentuk sewaan dan RM5.5 juta setahun dalam bentuk kos penyenggaraan.

Pembelian sebuah lagi jet peribadi baru yang kini di bawah pendaftaran 9H-AWK dan telah siap dicat dengan logo 1Malaysia (seperti di dalam gambar yang disertakan membuktikan bahawa pentadbiran Dato’ Seri Najib Tun Razak terus menerus bergelumang di dalam keborosan dan pembaziran, pada kala negara masih dikejutkan dengan skandal kewangan 1MDB.

Tindakan membeli sebuah lagi jet peribadi baru ini sudah tentu menimbulkan kemarahan rakyat pada kala rakyat terpaksa berdepan dengan pelaksanaan GST dalam tempoh 2 minggu dari sekarang. Rakyat terpaksa menanggung cukai baru yang sebahagiannya akan digunakan untuk membayar jet peribadi baru Perdana Menteri ini.

Saya mendesak supaya pembelian jet ini dibatalkan serta merta dan Dato’ Seri Najib Tun Razak meminta maaf dengan rakyat kerana tindakan membeli jet peribadi baru ini membelakangkan kepentingan rakyat.

Pembatalan Projek Lebuhraya Kinrara Damansara (KIDEX)

Kerajaan Negeri Selangor mengamalkan pendekatan mengambil kira pandangan orang ramai dalam menentukan kelulusan sesebuah projek agar ia membawa manfaat menyeluruh. Selain dari pembangunan ekonomi, pentadbiran Negeri Selangor turut menitikberatkan sumbangan sosial dan manusiawi dalam setiap projek yang diluluskan. Dasar pembangunan berkualiti, rakyat dipeduli akan menjadi teras dalam setiap pembangunan di Negeri Selangor.

Pertikaian mengenai kelulusan Lebuhraya Kinrara Damansara (KIDEX) sebelum ini banyak berkisar kepada persoalan – persoalan ini.

Kerajaan Negeri telah menggunapakai maklum balas orang ramai yang terbabit untuk menetapkan syarat – syarat khusus yang perlu dipatuhi. Kerajaan Negeri juga berpendirian bahawa pembinaan lebuhraya dalam Negeri Selangor perlulah bermanfaat bukan sahaja kepada pengguna lebuhraya tetapi juga dinikmati oleh penduduk di mana lebuhraya itu dibina. Pendirian ini telah diluluskan dalam pembentangan Belanjawan Negeri Selangor 2015 di Persidangan Dewan Negeri Selangor pada 24 November 2014.

Justeru, pihak konsesi KIDEX perlu memenuhi syarat – syarat berikut :

  1.    Menyediakan Penilaian Impak Lalulintas (Traffic Impact Assessment) yang bebas, Penilaian Impak Sosial (Social Impact Assessment) dan Penilaian Impak Alam Sekitar (Environmental Impact Assessment). Kajian – kajian ini perlu membuktikan manfaat yang ternyata kepada pihak pengguna dan penduduk kawasan yang terlibat setelah mengambil kira kesan negatif yang timbul akibat pembinaan lebuhraya tersebut.
  1. Mendedahkan kadar tol sepanjang tempoh konsesi termasuk segala kenaikan tol yang ditetapkan dalam konsesi. Pihak konsesi perlu memberikan anggaran rasmi jumlah tol yang akan dikutip dan kadar pulangan kepada pelaburan (rate of return to investment).
  1. Mendedahkan perjanjian konsesi sepenuhnya untuk mematuhi dasar kerajaan Pakatan Rakyat yang menegaskan ketelusan dan kebertanggungjawaban.

Kerajaan Negeri telah memaklumkan kepada KIDEX untuk mematuhi syarat – syarat ini sebelum 14 Februari 2015. Oleh kerana tidak ada satu pun syarat – syarat ini yang dipatuhi oleh KIDEX setelah tempoh masanya tamat, maka Kerajaan Negeri Selangor dengan ini mengumumkan pembatalan Projek Lebuhraya Kinrara Damansara (KIDEX).

Pendekatan yang sama akan digunakan dalam mempertimbangkan permohonan kelulusan oleh lebuhraya – lebuhraya lain yang dicadangkan di bawah bidang kuasa Kerajaan Negeri Selangor.

KEADILAN Kecam Keputusan Politik Kes Fitnah 2

KEADILAN mengecam sekeras-kerasnya penghakiman kes Fitnah 2 hari ini. Kes Fitnah 2 ini jelas adalah satu konspirasi politik yang bertujuan untuk melemahkan kebangkitan rakyat yang semakin hari semakin mengancam kedudukan Umno-Barisan Nasional.
Dapatan mahkamah (court finding) bahawa Saiful Bukhari adalah seorang saksi yang berwibawa jelas bertentangan dan tidak konsisten dengan kesemua bukti yang dibentang dan dihujah pihak pembelaan.
Keputusan hari ini memusnahkan keyakinan rakyat terhadap kebebasan institusi kehakiman.
Pemenjaraan saudara Anwar Ibrahim tidak akan melemahkan semangat dan daya juang kami. Malah KEADILAN akan memperkukuh kepimpinan dan jentera parti untuk meneruskan perjuangan melaksanakan agenda rakyat demi Malaysia yang lebih baik. Kami juga tekad untuk memperkukuhkan permuafakatan dalam Pakatan Rakyat.
Oleh itu, dalam masa terdekat, KEADILAN akan:
1) memfailkan usul di Parlimen untuk mengkritik perilaku hakim-hakim Mahkamah Persekutuan di dalam kes Fitnah 2 yang memenjarakan saudara Anwar Ibrahim
2) menggalakkan orang ramai untuk menyertai perhimpunan solidariti (vigil) di luar Penjara Sg Buloh setiap hari, bermula malam esok (Rabu, 11 Feb 2015)

Statement by Anwar Ibrahim upon the judgement of the Federal Court on 10th February 2015

I maintain my innocence of this foul charge – this incident never happened.

This is complete fabrication- coming from a political conspiracy to stop my political career.

You have not given proper consideration to the case presented by my counsel from day one – that this incident never happened at all.

I can go on and on but I see from your statement today that it will be fruitless – it appears as i have been condemned again as I was in the court of appeal. only here we went through a facade of an 8 day hearing!

It is not a coincidence how the of the PM was able to release a full written statement on your decision barely minutes afteryou handed your judgment today even before sentencing.

In bowing to the dictates of the political masters, you have become partners in crime for the murder of judicial independence and integrity. You have sold your souls to the devil, bartering your conscience for material gain and comfort and security of office.

You had the best opportunity to redeem yourselves – to right the wrongs of the past and put the judiciary on a clean slate and carve your names for posterity as true defenders of justice.

But instead you chose to remain on the dark side and drown your morals and your scruples in a sea of falsehood and subterfuge. Know you not that you are now wallowing in filth and foulness and the stench of your injustice will permeate through every nook and cranny of this so-called Palace of Justice and I do pity you all.

Yes, you have passed judgement on me – and I will, again for the third time, walk into prison but rest assured my head will be held high. The light shines on me.

But the shame is on you for you will be judged by history as the great cowards of humanity. Sitting on that high horse of judicial power, you have stooped so low to become the underlings of the political masters.

Students of law and professors of jurisprudence will scrutinise your
judgments and as they dissect your reasoning and your decision, your credibility and integrity will be torn to tatters. And you will be exposed as the fraudsters who don the robe of judicial power only to pervert the course of justice.

Do not forget that, as all of us will have to, you too will have to answer to your Maker. You will have to answer why you turned your backs on the principles that you had so solemnly sworn to uphold.

People who come into your court have to bow their heads and address you as ‘My Lords’ but don’t you know that you too will have to answer to your Lord one day? By then you will need more than bowing and prostration to justify why you wilfully transgressed Allah’s command
as ordained in Surah an-Nisaa, verse 58:

Going to jail, i consider a sacrifice i make for the people of this country.

I have fought most of my life on behalf of the people of this country – for the people I am willing to go to jail or face any other consequence.

My struggle will continue, wherever I am sent and whatever is done to me.

To my friends and fellow Malaysians let me thank you from the bottom of my heart for all the support you have given me. And Allah is my witness. I pledge and I will not be silenced, I will fight on for freedom and justice and I will never surrender!

Buku Jingga janji yang realistik & wajar

KUALA LUMPUR 17 MAC: Pandangan yang diutarakan Ahli Parlimen Rembau, Khairy Jamaluddin dalam sidang Dewan Rakyat semalam berhubung dasar penswastaan tol yang termaktub dalam Buku Jingga ternyata bukan berlandaskan inspirasi rakyat.

Ahli parlimen Balik Pulau, Yusmadi Yusof menyifatkan tahap pemahaman cetek pimpinan Umno-Barisan Nasional (BN) mengakibatkan kekeliruan berhubung beban tanggungan kerajaan sekiranya konsesi tol dimansuhkan.

“Isunya di sini bukan isu tidak cukup wang. Isunya ialah tata kelola. Bagaimana hasil yang cukup untuk diagihkan sama rata. Macam Ghandi kata apa yang kita ada ini adalah cukup untuk keperluan tapi tidak cukup untuk ketamakan kita.

“Jadi Rembau ini tidak akan faham isu ini. Pada pandangan saya kalau penswastaan yang dimaksudkan untuk mengurangkan beban kerajaan membina prasarana, sekarang konsesi ini patut ditamatkan,” jelas Yusmadi.

Khairy semalam mendakwa, pemansuhan tol seperti yang digariskan Pakatan Rakyat dalam janji 100 hari pentadbirannya akan membebankan kerajaan.

Namun kenyataan itu disanggah oleh Yusmadi yang berkata, perkongsian perkhidmatan menerusi tata kelola yang baik mampu mewujudkan kesamarataan seraya memberi pulangan besar kepada rakyat tanpa membebankan tanggungan kerajaan.

Ini sekaligus menyangkal tomahan kerajaan Umno-BN yang cuba memanipulasi kefahaman rakyat sehingga membuat kesimpulan bahawa negara akan muflis jika dasar ini dilaksanakan Pakatan Rakyat.

Sidang Dewan petang semalam dihangatkan apabila ahli-ahli parlimen Umno-BN cuba mencetuskan kesangsian terhadap pelaksanaan dasar Buku Jingga yang sering menjadi sasaran ejekan dan dakwaan tidak munasabah dalam dewan.

Yusmadi menambah, maksud penswastaan bukan menyerahkan secara total kepentingan kerajaan dan negara namun hanya sehingga suatu tahap di mana pulangan dikitar semula untuk manfaat kepada rakyat.

Katanya lagi, prinsip perkongsian pintar yang diketengahkan mampu menyangkal sebarang bentuk penindasan asalkan diurus dengan tata kelola yang bertanggungjawab.

“Penswastaan itu sendiri bukan bertujuan untuk membebankan, tapi untuk berkongsi perkhidmatan dan sampai ke suatu tahap kembali kepada rakyat. Bagi saya pandangan beliau (Khairy) ialah bukan pandangan berkepentingan rakyat dan tidak faham apa yang dimaksudkan dengan agenda penswastaan,” kata beliau lagi.

Antara perkara yang dinyatakan dalam Buku Jingga Pakatan Rakyat adalah dengan mengarahkan Khazanah Berhad, Kumpulan Wang Simpanan Pekerja (KWSP) dan lain-lain badan milik kerajaan yang memiliki konsesi lebuhraya untuk menyempurnakan ambil alih aset lebuhraya oleh kerajaaan dengan tujuan menghapuskan tol.

Selain penghapusan kadar tol, buku jingga berkenaan turut menjanjikan pemansuhan Akta keselamatan Dalam Negeri (ISA), merombak subsidi negara, membatalkan Felda Plantations, menaikkan royalti minyak di Sabah dan Sarawak dan penubuhan Suruhanjaya Diraja bagi memulihkan sistem kehakiman negara.

Mac 2011 – Pihak yang tidak bertanggungjawab telah membuang sampah sesuka hati mereka. Tindakan mereka telah menyebabkan kawasan menjadi kotor dan mengundang penyakit dan ketidakselesaan penduduk sekitar.

Namun, sikap mereka yang hanya mementingkan diri tidak menghiraukan itu semua. Sikap perlu berubah, bukan sahaja yang membuang sampah tetapi semua yang mahukan kebesihan dan keselesaan persekitaran.

Tempat membuang sampah ada disediakan di tempat yang sesuai tetapi tetap dibuang di tempat yang tidak dibenarkan. Pemantauan oleh penduduk sekitar sangat perlu bagi memastikan mereka yang bersalah dapat diambil tindakan ke atas mereka.

Rais describes Mallot’s criticism of Malaysia as outdated

11 Februari 2011 – KUALA LUMPUR: Information, Communication and Culture Minister Rais Yatim today described as outdated the criticism hurled at Malaysia by former United States ambassador to Malaysia John Malott, and said the latter’s intention was purely dirty politics.

He said that as an envoy, Malott should not take sides or adopt a stand which clearly reflected his political leaning.

“When he was the ambassador in Kuala Lumpur, Malott enjoyed the modernity and progress of our country. Of course, he preferred to associate himself with the opposition. We abhor such an envoy.

“We have to regard him as a political practitioner who is nothing more or less than (Opposition Leader) Anwar Ibrahim or as one of the members of PKR in Kuala Lumpur,” he told reporters after MIC president G Palanivel had called on him at his office, here.

Rais was asked to comment on Malott’s article titled “The Price of Malaysia’s Racism”, recently carried in The Asian Wall Street Journal, critical of the 1Malaysia concept initiated by Prime Minister Najib Tun Razak.

Malott had said, among others, that racial and religious tensions were higher today than when Najib took office as the prime minister in 2009.

Rais said Malott’s criticism was baseless because the judicial system, the parliamentary system and the national education system moulding 1Malaysia denizens were realities which people like Malott did not comprehend.

 “I am amazed that The Asian Wall Street Journal was willing to publish such an article,” he said.

He said the intention behind the article was dirty politics.
